If you are reading this, you already own a WonderSim eSIM card, which allows you to use mobile data services in various countries (hereinafter referred to as ‘Services’).
The eSIM card and the associated services are provided by WonderSim in accordance with these Terms and Conditions (T&Cs).

The service is only available via the WonderSim website and can only be used on an authorised device.
Please note:
The service is not available in all regions and on all devices and
is subject to the provisions of these General Terms and Conditions (GTC).
The service includes the provision of prepaid mobile data packages (a specific amount of data, valid for a specified period of time) that allow you to connect your device to the internet (hereinafter referred to as ‘data packages’).
The countries in which you can use the data packages are displayed when you browse the available offers on our website. These offers may change from time to time and may depend on the country in which you are staying.
By purchasing the service, you obtain permission to use the service and agree to make payment in accordance with the applicable terms and conditions.
These terms and conditions, including the provisions contained therein for the protection of your personal data (together, the ‘Agreement’), govern the general terms and conditions for your use of the service.
The terms ‘Customer’, ‘you’ and ‘your’ refer to you as the user of the Service. The terms ‘WonderSIM’, ‘we’, “us” and ‘our’ refer to GS Nomads, which operates under the WonderSIM trademark, and all affiliated companies involved in providing the Service.
By registering for the Service, using it or paying for it, you confirm that you unconditionally accept the Terms and Conditions as published in the contract at www.wondersim.be. If you do not agree, you may not use the Service.
We reserve the right to amend or supplement the contract from time to time, in accordance with the applicable legal provisions. Unless otherwise specified in the contract, all amendments or supplements shall come into effect upon publication on our website www.wondersim.be.
In the event of significant changes, we will endeavour to inform you separately.
Your continued use of the service after the changes have been published on the website shall be deemed to constitute your acceptance of these changes.
In order to provide the service, WonderSim has entered into agreements with various mobile network operators worldwide to use their mobile networks (collectively, the ‘Mobile Network’).
Please note:
WonderSim does not provide you with a telephone number and does not enable you to
make or receive voice calls (including
emergency calls such as 112 or other emergency numbers).
Sending or receiving SMS or text messages is also not possible with the Service
.
The contract comes into force and becomes legally binding between WonderSim and the customer as soon as the customer starts using the service. The contract remains in force until it is terminated in accordance with the provisions of the General Terms and Conditions (GTC).
The service is sold exclusively on a prepaid basis.
All services, including related offers and promotions, may be subject to additional, specific terms and conditions. Please check our website regularly, as these terms and conditions are updated from time to time.
You remain responsible to us under the contract for all actions performed by persons whom you have permitted to use the services via your account .
WonderSim provides the service in accordance with the contract and the description of the respective data package, from the moment the customer begins to use the service or purchases the data package.
We strive to make the Service available to you as much as possible. However, the availability and quality of the Service may be affected by factors beyond our control, such as physical obstacles, weather conditions or disruptions to the mobile network (the infrastructure, software and hardware required by a mobile network operator to provide wireless Internet services).
If such disruptions occur and their resolution is beyond our control, we are unfortunately unable to prevent them entirely.
We ourselves or our partners, the mobile network operators (i.e. companies that operate a mobile Internet network and own or control all the components necessary to provide mobile Internet services) must occasionally carry out work to upgrade or maintain the mobile network. This may temporarily affect the availability and/or quality of the service.
We try to keep such interruptions to a minimum, but cannot always guarantee this.
We provide the service with reasonable care and competence and endeavour to make the service available to you.
If you encounter any problems with our service or suspect fraudulent activity on your account, please contact our customer service immediately.
We reserve the right to modify the service from time to time without notice in order to comply with security requirements, legal requirements, regulations and other rules .
In doing so, we endeavour to ensure that such changes do not significantly affect the performance or scope of the service.
You must use the service in accordance with the contract and any other reasonable instructions that we or our customer service department may give you from time to time.
In particular, you are not permitted to use the eSIM card in any device other than the one with which it was supplied or for which it is intended (if it was not supplied with the card).
Furthermore, the eSIM card remains the property of WonderSim and/or its selected partners.
When opening your account, you must inform us of your country of residence.
Depending on applicable law, you are also required to provide us with a copy of your identity card or passport – either before you start using the services or within fifteen (15) days of starting to use the services at the latest.
If you do not comply with this requirement, we reserve the right to suspend the service immediately.
The eSIM card does not have a PIN code by default.
You are solely responsible for controlling access to your eSIM card and agree to pay for the service, regardless of whether you have authorised its use or not.
We accept no liability for fraudulent use of your eSIM card.
If you suspect that your eSIM card is being used without authorisation,
please contact our customer service immediately so that appropriate measures can be taken on your
account.
The eSIM card is assigned to the first owner of the device.
This first owner remains responsible for the use of the card at all times, unless
WonderSim has received proof of a device change.
The service is intended for surfing the Internet, email, downloading and
uploading apps and content from the internet or third-party apps
– usage should not place an excessive load on the network.
You may not use the service for illegal, abusive or fraudulent purposes,
in particular in a manner that:
Furthermore, you may not use the service in a manner that compromises the security or
performance of the network, places an excessive and
disproportionate load on the network, negatively affects the quality of service or legitimate data streams,
reduces network performance, or causes damage to the network or other customers
. You may not take any action that, in WonderSim's opinion, interferes with the service or
other WonderSim customers, infringes on the rights of third parties, or
is considered inappropriate behaviour in any way.
If we have reason to believe that you or someone using your eSIM card is
misusing the service or violating the agreement, we may immediately suspend,
restrict or terminate your eSIM card and your ability to use the service without prior notice.
In addition, we reserve the right, at our sole discretion and for any reason
: You are responsible for all charges on your account, whether or not they were incurred by
you personally, except for charges incurred after written
confirmation by our customer service department after you have reported the loss or
theft of your eSIM card.
If you are under 18 years of age, your parent or legal guardian must also read and accept the
Terms and Conditions.
You agree to be responsible for paying the usage fees for the service
or, if you are under 18, to have the permission of the responsible
adult to pay the fees.
You acknowledge that WonderSim may immediately suspend certain services in order to comply with applicable
law.
You are solely responsible for the content you transmit via the service. We
accept no liability for content sent or received by you.
You are obliged to inform our customer service as soon as possible of any changes to your
contact details.
To use the service, you need a valid data package. A data package is
valid if it has not been used up or expired and can be used in the country in which you are located
.
You can check whether your data package is still valid at any time on the WonderSim website.
Once your data package has been used up or has expired, your Internet access will be
automatically blocked.
Use of the data package will be charged according to your consumption (consumption
of your data allowance). The data package can only be used for our service on your device. There is no
entitlement to a refund for unused data volume, unless otherwise expressly stated in the contract
.
Credit balances and allowances are non-transferable and no interest is paid on credit balances
or remaining volume. You are obliged to pay all taxes, duties, surcharges and other fees that
we charge you for the service, unless you can prove, at our
discretion, that you are exempt from them.
We will not notify you in advance of changes to taxes, duties, surcharges or
other fees, unless required to do so by applicable law. We may suspend or deactivate the service and/or your eSIM card without prior notice and without
liability to you if: If we suspend or deactivate your service, you will have the opportunity to reactivate the service
within 3 months of the suspension, provided you
meet WonderSim's requirements.
We do not guarantee the accuracy, completeness, reliability or
availability of the content or information on third-party websites or resources that
the service provides access to.

It is your responsibility to protect your device with appropriate anti-virus software.
You must use the Service in accordance with this Agreement and any other reasonable instructions
we or customer service may give you from time to time. In particular, you are
not permitted to use the eSIM card in any device other than the one with which it
was supplied.
If you have purchased an eSIM package on the WonderSim website or other online platforms,
it is your responsibility to ensure that your device is eSIM-compatible
and has not been locked by a network operator.
We provide a non-exhaustive list of compatible devices, but this does not take into account
market-specific features. Please always check the
manufacturer's specifications for your device to ensure compatibility.
For an eSIM profile with a preloaded data package that you purchased on our website
: A refund is only possible if you have not yet scanned the QR code
received by email
after purchase.
If you have already scanned the QR code
, your refund request will be rejected.
For an eSIM profile with a pre-loaded data package that you purchased on our website
but your phone is locked by the network operator: Refunds for
devices that are ‘network locked’ (or ‘eSIM locked’) are not possible. The
description of the data package under ‘How to use’ indicates that you
must ensure that your device is not locked by the network operator.
If your phone is locked, you can contact the network operator from whom you purchased your device
and request that it be unlocked (to do this, you simply need to provide the IMEI number,
which you can find in your device's settings). Note: The pre-loaded eSIM data packages in the form of QR codes are valid for
6 months from the date of purchase.
When topping up via your existing WonderSim account: Once you have topped up your WonderSim
account, the purchased data packages cannot be refunded once
you have used the service.
Technical problems and refunds
If technical problems arise during the activation of the services due to WonderSim,
a refund is possible from the time the problem occurs.
Exchanging data packages or transferring them to other WonderSim accounts is
not possible. To request a refund, please contact customer service (via
the online form) within 14 working days of the purchase date or the occurrence of the technical issue, and include the payment confirmation or proof of payment.
Upon receipt of your request, you will receive a confirmation of receipt.
Refunds will be made within 10 working days via the payment method used at the time of purchase. The refund

In accordance with applicable law, you agree to defend, indemnify and hold harmless WonderSim and its affiliates,
subsidiaries, shareholders, directors, employees and
agents at your own expense, indemnify them and hold them harmless from any liability.

damages (including, but not limited to, reasonable legal fees) arising out of
or in connection with
Unless we are guilty of intentional breach of duty, our liability for damages is limited to the
amount you actually paid us for use of the service in the month prior to the occurrence of the damage

We are not liable for indirect, special, consequential, incidental or punitive damages, in particular lost
profits, loss of income or increased operating costs, even if such
damages were foreseeable or we were advised of their possibility.
This limitation of liability applies regardless of the legal basis for the claim, whether
it be contract, tort, statute or otherwise.
WE MAKE NO WARRANTY OF ANY KIND, EITHER EXPRESS OR
IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES REGARDING
TITLE, NON-INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS, MERCHANTABILITY,
TECHNICAL COMPATIBILITY OR FITNESS FOR A PARTICULAR PURPOSE WITH RESPECT TO ALL
SERVICES, PRODUCTS OR MATERIALS PROVIDED UNDER THE CONTRACT AND ON
THIS WEBSITE. WE ALSO DO NOT WARRANT THAT THE SERVICE
WILL BE UNINTERRUPTED OR ERROR-FREE.
NO ONE, INCLUDING OUR EMPLOYEES, AGENTS OR REPRESENTATIVES, IS
AUTHORISED TO MAKE ANY WARRANTY BEYOND THESE TERMS.
NO ONE IS AUTHORISED TO MAKE ANY WARRANTY OF ANY KIND ON OUR BEHALF,
AND YOU SHOULD NOT RELY ON ANY SUCH WARRANTY.
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT THE SERVICE IS PROVIDED IN PART OVER NETWORKS
OVER WHICH WE HAVE NO CONTROL, AND THAT THIS SERVICE IS SUBJECT TO FAILURES,
INTERRUPTIONS AND DISRUPTIONS FOR WHICH WE ASSUME NO LIABILITY.
WONDERSIM IS NOT RESPONSIBLE FOR THE CONTENT OF COMMUNICATIONS TRANSMITTED THROUGH THE SERVICE.
‘Personal data’ means any information relating to an identified or
identifiable natural person. An identifiable natural person is a
a person who can be identified, directly or indirectly, in particular by reference
to an identifier such as a name, an identification card, an identification number,
location data, economic data, an online identifier or to one or more
special characteristics of physical identity.
Your personal data is collected by WonderSim in order to optimise the efficient operation of the
service and to comply with applicable laws and regulations regarding user identification.
The data will be deleted at the end of your contract or within one year of
the end of the contract, unless a longer retention period is required or permitted by law
.
Your personal data is collected by WonderSim in accordance with Regulation (EU) 2016/679 of the
European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the
processing of personal data and on the free movement of such data (‘GDPR’) and in accordance with all
data protection regulations applicable in your jurisdiction.
In particular, the security and confidentiality of your personal data will always be
protected in accordance with the GDPR, even if you are not a citizen of a Member State of the
European Union.
The processing of your personal data may only be carried out by WonderSim or its
processors, provided that these processors are contractually bound to
WonderSim and comply with the provisions of the GDPR.
In the event of a transfer of your personal data outside the European Union,
protection comparable to European regulations is guaranteed.
You have the right to access, rectify and object to the processing of
your personal data at any time.

domain names of WonderSim (collectively, the ‘Trademarks’) are and remain the exclusive
property of WonderSim. Nothing in this Agreement grants you a licence to use these
Trademarks without our prior written consent.
We may assign all or part of our rights and obligations
under the Agreement to third parties at any time without prior notice. In such case, we shall no longer be liable to you for the assigned
functions.
You may assign your rights Should any provision of this contract be wholly or partially invalid, illegal or
unenforceable, the remaining provisions of the contract shall remain in full force and effect. This Agreement and any written amendments or supplements constitute the entire
agreement between you and WonderSim with respect to the Service and supersede all prior
or contemporaneous agreements or understandings, whether written, electronic or oral,
between you and WonderSim. No written or oral statement, advertisement or
service description that is not expressly included in the Agreement shall contradict, explain
,
modify or supplement it. You acknowledge and agree that you will not rely on
any representations or statements made by WonderSim that are not included in the Agreement.
WonderSim shall not be liable for any delay or failure to perform its obligations under the Agreement to the extent that such
delay or failure is caused by fire, flood, explosion, war, embargo,
governmental orders, civil or military authorities, acts of God or other
comparable causes beyond WonderSim's control.
WonderSim's failure to exercise any of its rights under this contract in the event of a breach by the
customer or due to a condition, obligation or provision of the contract
shall not be construed as a waiver of those rights, nor as a waiver of the same
or any other future breach of contract.
Unless otherwise required by law, Belgian law shall apply and the
exclusive jurisdiction of the courts in Eupen shall apply.
